Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the HZ Chat messaging service (the “Service”). By accessing or using the Service, you agree to be bound by these Terms.

HZ Chat operates as a non-persistent, session-based messaging platform. Text messages are transmitted in real time and are not stored permanently after a session ends. File attachments are stored temporarily and are automatically deleted upon expiration.

The Service may be provided in beta or evolving form. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

1. Acceptance and Scope

1.1 Acceptance of Agreement

By accessing or using the HZ Chat service in any way, you acknowledge that you have read, understood, and agree to be bound by all the terms of this Agreement. If you do not agree to any part of this Agreement, please cease using the service immediately.

1.2 Service Tiers and Account Types

The service provides different functional quotas and management privileges based on the user’s tier:

  • Guest Users: Access to basic temporary messaging features without the need for account registration.

  • Registered Users: By creating an account, users enjoy higher base usage quotas and account management capabilities compared to Guests.

1.3 Minor Disclaimer

This service is not designed for minors. Users who have not reached the age of legal majority in their jurisdiction (minors) should use this service only under the supervision and guidance of a legal guardian. You understand and agree that HZ Chat is not responsible for any consequences arising from a minor’s use of the service.

2. User Conduct and Content Responsibility

2.1 Content Ownership and Temporary License

You retain ownership of all content (including text and files) you post on HZ Chat. To enable the core functionality of the service (i.e., real-time relay, display, temporary storage, and secure in-room access of your messages and attachments), you hereby grant HZ Chat a temporary, irrevocable, royalty-free license to relay, display, temporarily store, and securely enable in-room access to your User Content.

This license is valid only for the duration of the current session for text messages; for file attachments, this license is valid for 24 hours after file upload. The license shall immediately and automatically terminate upon the expiration of the respective retention period.

2.2 User Content Responsibility and Reporting Mechanism

HZ Chat does not perform proactive or real-time review of User Content. Due to the non-persistent nature of the service, file content is hosted only for a very limited duration. You understand and agree that you are solely responsible for all content (including files) that you send or share through this service.

To maintain community safety, HZ Chat provides a Reporting Mechanism. Users may report prohibited content, and HZ Chat may conduct manual verification and take appropriate action based on the report and any available essential evidence.

2.3 Prohibited Conduct

You commit that, when using the service, you will not send, transmit, or share any content that violates applicable laws and regulations, including but not limited to:

  1. Any content that is unlawful, obscene, pornographic, threatening, or defamatory.
  2. Content that promotes violence, hate speech, or discrimination against any group.
  3. Content that infringes upon the intellectual property or privacy rights of any third party.
  4. Content that contains any form of malware, viruses, or other harmful code.

2.4 File Attachments and Automatic Purge

When you upload files as attachments, the file content is stored in an encrypted object storage space controlled by HZ Chat. All uploaded files will be automatically and permanently deleted within 24 hours. You understand and agree that you are responsible for the legality and security of the file content and bear all risks arising from the file storage and auto-deletion mechanism.

2.5 Violation Enforcement

You acknowledge and agree that if HZ Chat receives a report of a user posting unlawful content, or detects any abusive behavior, the platform reserves the right to take the following actions without liability:

  1. Immediate Connection Interruption: To immediately terminate your current connection and session.

  2. Rate Limiting: To implement traffic limitations based on your IP address to prevent continued abusive behavior.

  3. Account Termination: For Registered Users, the platform reserves the right to permanently ban the account based on the severity of the violation.

3. Service Tiers and Future Subscriptions

3.1 Permanent Free Tiers

HZ Chat provides permanent free services for Guest Users and Registered Users. These free tiers include essential messaging and file-sharing capabilities as defined in our current service quotas. We commit that these core features for non-subscribers will remain free of charge beyond the Beta stage.

3.2 Optional Pro Subscriptions

To sustain an ad-free environment while ensuring high-quality service and infrastructure maintenance, we may introduce an optional Pro Subscription tier in the future. This voluntary upgrade is designed for users who require expanded capabilities beyond the base quotas, such as increased participant limits, higher file size thresholds, and advanced chat management features. The core messaging experience will remain free, and any future transition to a paid tier will be handled via secure, industry-standard payment processors with full user consent.

4. Disclaimers and Limitation of Liability

4.1 Service Provided “As Is”

The Service is provided on an “As Is” and “As Available” basis, without warranties of any kind, whether express or implied. We do not guarantee that the service will be uninterrupted, timely, secure, error-free, or meet your specific requirements.

4.2 Non-persistent Nature and Data Clearance Disclaimer

Based on HZ Chat’s “Non-persistent by Design” architecture, data clearance is automatic and irreversible. You acknowledge and agree that:

  • You are solely responsible for the immediate backup of all essential data.

  • HZ Chat shall not be liable for any loss or corruption of data resulting from the 24-hour automatic purge mechanism, system failures, or accidental loss.

  • Once data has been purged upon the expiration of the retention period, it cannot be recovered through any technical means.

4.3 Data Privacy and Rights

We process your personal data only as necessary to provide our services and ensure account security. Under regulations such as the GDPR, you have the right to access, correct, or request the deletion of your personal account data (the “right to be forgotten”). All data handling practices are further detailed in our Privacy Policy.

4.4 Limitation of Liability

To the maximum extent permitted by applicable law, HZ Chat shall not be liable for any direct, indirect, incidental, special, or consequential damages (including but not limited to loss of profits, data loss, or business interruption) arising out of or in connection with the use or inability to use this service. This limitation applies even if we have been advised of the possibility of such damages.

5. Governing Law and Contact

5.1 Governing Law and Dispute Resolution

This Agreement is a contract between you and HZ Chat. The interpretation, validity, and resolution of disputes arising from this Agreement shall be governed by the laws of the Republic of Singapore. Any dispute arising from this Agreement shall first be resolved through friendly negotiation; if no resolution can be reached, both parties agree to submit the dispute to the courts of the Republic of Singapore for litigation.

5.2 Agreement Updates

We may revise this Agreement periodically. The updated version will be effective immediately upon posting.
